Right of Withdrawal for Consumers
(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither related to their commercial nor their independent professional activity.)

Withdrawal Instructions

Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the day

- on which you or a third party named by you, who is not the carrier, has taken possession of the goods, if you have ordered one or more goods in a single order and these are delivered together;

- on which you or a third party named by you, who is not the carrier, has taken possession of the last good, if you have ordered several goods in a single order and these are delivered separately;

- on which you or a third party named by you, who is not the carrier, has taken possession of the last partial shipment or the last piece, if you have ordered a product that is delivered in several partial shipments or pieces;

- on which you or a third party named by you, who is not the carrier, has taken possession of the first good, if goods are delivered to you regularly over a fixed period within the scope of an order.

To exercise your right of withdrawal, you must inform us (Kaufbei GmbH, Oeynhausener Str. 54, 32584 Löhne, Phone: 05731-2451510, Fax: 05731-2451582, Email: post (at)kaufbei.tv) with an unequivocal statement (e.g. a letter sent by post, fax or e-mail) of your decision to withdraw from this contract. You can use the attached model withdrawal form, but it is not mandatory.

In order to meet the withdrawal deadline, it is sufficient for you to send the communication regarding the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments received from you, including the costs of delivery (except for the additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without delay and no later than fourteen days from the day we receive the notice of your withdrawal from this contract. For this refund, we will use the same payment method you used for the original transaction, unless explicitly agreed otherwise with you; in no case will you be charged any fees for this refund.

We may refuse the refund until we have received the goods back or until you have provided evidence that you have sent back the goods, whichever occurs first.

You must return the goods without delay and in any case no later than fourteen days from the day on which you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods if this loss in value is due to handling the goods in a way that is not necessary to check the nature, characteristics, and functioning of the goods.

Exclusion or Expiration of the Right of Withdrawal

The right of withdrawal does not apply to contracts

- for the delivery of goods that are not pre-manufactured and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer;

- for the delivery of goods that can spoil quickly (these items are excluded from the right of withdrawal according to § 312g Abs. 2 Nr. 2 BGB and § 2 Abs. 2 LMHV) or whose expiration date would be quickly exceeded, according to the Food Hygiene Regulation, these include perishable foods such as fruits, many types of vegetables, dairy products, meat, sausages, or fish. Therefore, our sausages, steaks, and deli products are excluded from return.

- for the delivery of alcoholic beverages, the price of which was agreed upon at the conclusion of the contract, but which can be delivered only 30 days after the conclusion of the contract, and whose current value depends on market fluctuations beyond the entrepreneur's control;

- for the delivery of newspapers, magazines, or periodicals, except for subscription contracts. The right of withdrawal expires prematurely in contracts

- for the delivery of sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been removed after delivery;

- for the delivery of goods that, due to their nature, are inseparably mixed with other goods after delivery;

- for the delivery of audio or video recordings or computer software in a sealed package if the seal has been removed after delivery.​
