Information on the Battery Ordinance
The German Battery Ordinance aims to reduce the entry of harmful substances into waste through batteries by prohibiting the marketing of certain harmful batteries and establishing take-back obligations.
The basic background of the Battery Ordinance – which you can always find more information about through the links provided below – is the seller's obligation to offer appropriate return systems for sold batteries, accumulators, etc.
- Batteries do not belong in household waste
- Batteries are special waste that needs to be disposed of
- As a seller, we are obliged to offer you, the customer, return options for batteries
- As a seller, we are required to ensure that we accept batteries here on-site or offer you return options at a reasonable distance from your location.
Excerpt from the Battery Ordinance
§ 5 Obligations of Distributors (1) 1Anyone who sells batteries to end consumers is obligated to take back batteries free of charge from the end consumer at the point of sale or in its immediate vicinity. 2In mail-order trade, the return must be ensured by appropriate return options at a reasonable distance from the end consumer. 3The obligation to take back according to sentence 1 is limited to batteries of the type that the distributor has in its assortment or has had, as well as to the quantity that end consumers typically dispose of. (2) 1The distributor is obliged to transfer the returned batteries to a return system of the manufacturers according to § 4 Abs. 2 or, if a manufacturer has set up its own return system according to § 4 Abs. 3, to transfer them to that. 2§ 4 Abs. 3 sentence 4 remains unaffected. (3) Paragraph 2 does not apply to starter batteries or the batteries mentioned in § 8. (4) § 4 Abs. 5 applies accordingly.
Explanations
Batteries or accumulators containing harmful substances are marked with the symbol of a crossed-out trash can.
Next to the trash can symbol, the chemical designation of the harmful substance appears. "CD" stands for Cadmium, "Pb" for Lead, and "Hg" for Mercury. If in doubt, please contact us.
